Black campaign asks TV stations to stop airing PAC-sponsored attack ad

The front page of The Tenenssean the day the driver’s license bill passed the General Assembly in April 2001.

An attorney for Diane Black’s gubernatorial campaign is asking TV stations to stop airing a TV ad that declares “Dishonest Diane Black” is “good for illegal immigrants, bad for Tennessee.” So reports The Tennessean, which obtained a copy of a letter sent to Knoxville TV station WVLT.

The ad was paid for by a political action committee, known as Tennessee Jobs Now, which supports one of Black’s GOP competitors — Knoxville entrepreneur Randy Boyd. (Previous post  with video and text of the ad, HERE.)

“To permit recirculation of this advertisement would condone the disclosure of plainly false and misleading statements that lack any nexus with the factual citations contained within the advertisement,” wrote Rocklan W. King III, an attorney with Adams and Reese LLP.

Chris Hartline, a spokesman for Black’s campaign, said similar letters were sent to other TV stations throughout the state.

“As is common practice, we’ve requested that TV stations review the blatantly false ads being run by allies of Randy Boyd, particularly considering that they’ve already been forced to take their false ads off the air twice,” Hartline said.

King noted that the original version of the ad cited the wrong bill in Congress to suggest Black didn’t support Trump’s proposed wall. Although the original ad cited a bill that had nothing to do with border security, the 30-second spot has since been changed.

King also argued that the legislation Black voted for when she was in the legislature related to driver’s licenses did not actually allow illegal immigrants to obtain one.

“This bill permitted a person without a social security number to receive a driver’s license if the person submitted an affidavit affirming that such person has never been issued a social security number,” King wrote.

… (I)n a May 24 letter, an attorney for the PAC stood by the assertion regarding the ad’s accuracy.

Gardner Pate, a Texas-based attorney, notes that the appropriations bill cited in the ad that Black voted against provided funding regarding border security.

“The White House and the President both publicly stated that HR 1625 included some funding for President Trump’s border wall,” Pate wrote.

…”On its face, the advertisement is correct and accurate,” he concludes. “We respectfully request your station continue to allow Tennessee Jobs Now to air its advertisement.”

    Hypocrites. And…why a TX attorney?

  • Lance Persson says:

In my opinion WE NEED TO TOTALLY GET RID OF ALL PAC’s.

PACs provide a way for big money to influence elections while hiding behind an organization whose supporters are not identified. It is only common sense that this type of organization is not healthy if we want a nation that is “of the people, by the people and for the people”.

    • Stuart I. Anderson says:

Absolutely Lance, as soon as we get rid of campaign finance laws that limit the amount of money people can openly give to campaigns thus limiting their right of free speech. That’s the trouble with government regulations that liberals are so fond of, one regulation has unintended consequences that call for another regulation each one reducing the quantum of freedom we have in this country.

Unlimited contributions/immediate disclosure – LET FREEDOM RING!!!!

    • Bill Tyler says:

I agree. On one hand and individual can get it up to $5000. On the other hand a ‘group of individuals have can’t contribute unlimited funds. So any person can contribute any amount to a PAC.

This all came about around the time that corporations were defined as individuals by the Supreme Court. Rest in peace Anthony Scalia.

If it were not in the United States, I would swear that we’re living in a banana republic.

    Don’t vote for #DirtyDiane !

  • Bob Fischer says:

Unlimited contributions only increase the control corporate dictators have over the politicians they’ve bought, like Diane Black. Money is not free speech. Eliminate all campaign contributions over $25.00. Enforce it with jail time.

  • Michelle Willard says:

Diane Black tried the same tactic to silence Lou Ann Zelenik back in 2012 and ended up filing a lawsuit to stop the attack ads.

From the article: “David Black, husband of Diane Black (R-Gallatin), and his drug testing firm, Aegis Sciences Corporation, filed suit in the midst of a hotly contested U.S. House primary campaign against Lou Ann Zelenik in 2010 after her campaign began airing ads that accused Black of steering millions of dollars in no-bid state contracts to her husband’s firm through her position as a state senator, in violation of state law.”The communication was true or at least substantially true,” reads the April ruling by Binkley, who sided with Zelenik and summarily dismissed Black’s lawsuit as frivolous.”

As I recall, Ms. Black’s husband was the only one and his company the only one to fill the job. No other companies had the capabilities to perform the job, hence he got the job.

      • Bob Fischer says:

It’s called bid-rigging. You set conditions that only one company can meet. Lots of firms can and could have run those tests. The reason they didn’t have an open bid was because it was rigged. They should have charged her and sent her to jail then.
